The ASU is the largest Union in the airline industry, we represent members at all Airlines, Ground Handling companies and contractors to the aviation industry throughout Australia.
We represent large numbers of members at places such as Qantas, Jetstar, Virgin, Toll Dnata and Menzies as well as most of the overseas carriers such as Emirates, Malaysian, Singapore, Garuda to mention a few. We also represent members in the freight and logistics areas as well. The ASU represents approx 120,000 members Nationally
What have we been doing?
The ASU on your behalf has been investigating the rates of pay and terms and conditions paid to you by Cloudbreak.
The ASU has been gathering evidence to ensure that we have what we need to run a case against Toll Dnata and or Cloudbreak to make sure that they pay you what you are owed and what you deserve.
We say that Toll Dnata has an obligation under its Enterprise Bargaining Agreement (EBA) to ensure that Cloudbreak pay you the same rates of pay and terms and conditions as Toll Dnata employees when performing duties for Toll Dnata. We also say that Cloudbreak have an obligation to pay industry rates of pay regardless of which airline or ground handling company that they provide services to.
The ASU has also stated its position in writing to Toll Dnata, met with company representatives and has also arranged to meet with Nigel Haworth (Cloudbreak CEO) to resolve the issues.
What is an EBA?
The ASU has what is known as an Enterprise Bargaining Agreement (EBA) with Toll Dnata. The EBA contains all of the terms and conditions of employment, rates of pay as well as many other provisions that determine what employees get when they attend work. The EBA also allows for regular pay increases. The EBA was
negotiated by the Union to ensure all individuals were paid the same and enjoyed the same terms and conditions of employment and to allow people to negotiate collectively for a fair outcome.
Toll Dnata employees receive higher hourly rates of pay for the same work that you are currently doing, they also receive;
• Shift penalties
• Weekend Rates (150% Sat, double time Sunday) • Overtime rates at double time
• Public holiday penalties and Days in Lieu
• Various allowances
• Parking is provided and paid for by the
company
• ASIC’s are paid for by the company
• Uniforms are supplied and paid for by the
company
Why is Toll Dnata’s EBA relevant to us?
In Toll’s EBA the Union negotiated a job security clause. Under the job security clause it clearly states that if Toll want to engage contractors (such as Cloudbreak) to do work then they have to ensure that you are paid the same as its own employees.
What will the ASU do for me?
The ASU will ensure that Toll Dnata and Cloudbreak are held to account and pay what they are legally obliged to pay. We will ensure that we pursue any money that is owed to Union members including any back pay that you are owed and reimbursement for expenses incurred by you that should have been paid by the company.
