Toll Dnata have knowingly engaged a contractor to do work currently done by you who are paying their employees $16 per hour with no penalty rates.
If it was up to Toll Dnata you would all be on significantly less. If it was not for the fact that you had an EBA negotiated by the Union then you would be on much lower rates of pay.
The company that Toll Dnata has engaged is called Cloudbreak Aviation Services, it would appear that they have been engaged Nationally.
Not only have they engaged this company to do your work, they have provided them with an office and are waving the attack on your terms and conditions right under your nose.
It is important to note that the employees of Cloudbreak are not at fault and it is their employer that is paying them below industry rates and standards, and it is your employer Toll Dnata that is allowing this to happen.
Cloudbreak Aviation Services are paying their workers;
• $16 per hour
• No shift penalties
• No Weekend Rates
• No overtime rates
• No public holiday penalties
• No allowances
• Are making employees pay for parking
• Made employees pay for their own ASIC’s
• Made employees pay for their own uniforms
The ASU will Hold Toll Dnata to account.
When the ASU negotiated your EBA we ensured that there was a job security clause contained in it. Effectively this clause does not allow Toll Dnata to engage a contractor to do your work unless the employees of that contractor are paid exactly the same terms and conditions as you. This clause is designed to be a disincentive to contract out your work and the ASU will be ensuring that your EBA is enforced and Toll Dnata is held to account.
Cloudbreak Employees
The ASU will also be meeting with Cloudbreak to ensure that they are clear of their obligations to their employees and to ensure that they are not allowed to continue to undercut industry terms and conditions by paying rates of pay that are appalling by industry standards.
We will also be ensuring that the Cloudbreak employees that are members of the Union are paid everything they are owed, the ASU will always fight to maintain an industry standard that pays fair rates of pay with decent terms and conditions and will take on all comers that try to take advantage of workers.
What can you do?
It’s time that everyone got involved and joined the Union.
Your EBA is due to expire this year and Toll Dnata’s intentions are clear, they want to reduce terms and conditions and you can be sure they’ll want to try and take away the job security clause that helps protect your rates of pay. We need everybody to join so that we can ensure that we get a good outcome during negotiations by all of us sticking together.
